After deadly ELPD shooting, prosecutor cites conflict of interest and refers case to AG

LANSING, Mich. (WLNS) — The Michigan State Police has investigated the officer-involved shooting of Isaiah Kirby on April 15, when officers shot and killed a man armed with a knife who was running towards them.

Immediately before the shooting, Douglas Mielock had been stabbed multiple times in what the Ingham County Prosecutor's Office described as an alleged assault involving Kirby.

The MSP's findings have been submitted to the Ingham County Prosecutor's Office — the standard next step for any law enforcement use of force.

The Prosecutor's Office added that it has a standing policy of referring any deadly officer-involved shooting to the Michigan Department of Attorney General for independent review. In this case, Ingham County Prosecutor John Dewane disclosed that a personal and professional relationship with Douglas Mielock, the stabbing victim, created a conflict of interest that makes independent review not only standard practice, but mandatory, the Prosecutor's Office said.

“This case has been formally referred to the Michigan Department of Attorney General's Office for review and any further determination regarding potential criminal charges,†the office said in its statement.

No charges have been filed against any of the officers involved. The attorney general's office will now determine whether use of force was legally justified and whether criminal charges are warranted.

The AG's office did not immediately respond to a request for comment.
